In Tennessee, Mediation is governed by Rule 31.  So if you have a contested divorce, the Court will likely order you to mediate. Sometimes more than once! Next, your attorney will likely discuss mediation options with you. Here is what you need to know.

Top 3 Reasons to Use a Rule 31 Listed Mediator for Mediation in Tennessee

First, JUDICIAL IMMUNITY.  Rule 31 Listed Mediators have judicial immunity.  Consequently, they cannot be called as a witness against you in court.  There are some rare exceptions. Your Tennessee Mediator will go over them with you. Almost everything you confide to the mediator during your joint and private sessions is confidential. Therefore, tell them everything!

Second, PROPER TRAINING. Rule 31 Listed Mediators are required to take an initial training course. Next, they have mandatory Continuing Education every 2 years. There is also a commission that handles complaints against mediators if they are Listed. It is called the ADRC. Finally, trained mediators understand the forms and documents. These are required to be submitted to the court properly.

Third, SETTLEMENT. Using a mediator doesn’t mean that you give up your right to a court date.  Or your attorney. It is not arbitration. Therefore, the parties make all the decisions.  Most parties bring their attorneys with them to mediation. Also, they work hard to settle their case outside of the formal court process.  Finally, if you cannot settle, you still have the right to go to Court. Then you will be heard in front of your judge.
