Review your Tennessee Permanent Parenting Plan.

It’s the perfect time of year to review your Tennessee Permanent Parenting Plan. Tax documents are coming in and it might be time to adjust the Child Support Worksheet. Tax documents are normally sent out by January 31 each year. You can also see if there has been a change in circumstance, like a new baby added to the family or a new marriage.

Section III. C. – deadlines are coming!

The Tennessee Permanent Parenting Plan requires each parent to exchange tax information. Specifically:

  1. IRS Forms W-2 and 1099 shall be sent to the other parent on or before February 15
  2. A copy of your client’s federal income tax return shall be sent to the other parent on or before April 15 or any later date when it is due because of an extension of time for filing
  3. If your client is paying work-related child care expenses, they shall send proof of expenses to the other parent for the prior calendar year and an estimate for the next calendar year, on or before February 15

Are you a parent receiving benefits?

If you are receiving benefits from the Department of Human Services, a completed form required by the Department of Human Services shall be sent to the Department on or before the date the federal income tax return is due by the parent paying child support.

Who is claiming the child on Taxes?

The child support schedule assumptions in the guidelines (1240-2-4-.03 (6)(b)) assume that the parent receiving child support will get the tax exemptions for the child. Some parents agree to alternate years for claiming the child. If you have multiple children, you could agree to each claiming one child every year. This section is often changed in the PPLAN, so double check your existing Tennessee Permanent Parenting Plan to see which parent is currently claiming the child. 

Do you have the most current form?

Want to make a change in your current Tennessee Permanent Parenting Plan? The Tennessee Permanent Parenting Plan is updated every few years. The most current form was updated January 4, 2021. Make sure you are using the most current version of the document. Most plans require you to go to Mediation before going to Court to ask for changes to the Plan.

    The backpacks are full, lunches are packed, new clothes are laid out, but are you ready to start co-parenting for the new school year?

    Here are some helpful tips to make things easier this school year.

    Tip One

    Make sure the school knows who is authorized to pick up the kids. You may need to update this list to include a reliable friend or a new babysitter. You may even need to add your co-parent if they have not been on the list previously.

    Tip Two

    Make sure your kids know their schedule. While it’s never a good idea to talk negatively about the co-parent, you do need to let the kids who will picking them up or which bus they need to ride home. Remember this can be very stressful for kids, so don’t be afraid to send a note to their teacher if they need a reminder. If you need help deciding which parenting plan may be best for your situation, check out THIS VIDEO.

    Tip Three

    Do you need a date – with your kids? It is normal for kids to miss the other parent during a week with only one parent. Consider adding a dinner night once a week where you can check in about homework, teachers, extracurriculars, etc. Zoom isn’t just for business! Can’t meet in person? Try an online date scheduled for a specific time. Even if it’s just dessert, you can share a favorite candy together during FaceTime.

    Tip Four 

    Work together to keep schedules similar. Homework time, snack rules, bedtime and grade expectations are just a few of issues you should be discussing with your co-parent. Don’t want to meet in person? Use a parenting app to text. Remember to be “professional” in all communications, even when you are frustrated.

    Now that school is back, co-parenting for the new school year should be a top priority.

    NEW CHANGES FOR TENNESSEE PARENTS

    After roughly a decade with no updates, Tennessee changed their Tennessee Child Support Calculator. The calculation is effective May 10, 2020. The Tennessee Parenting Plan has NOT changed (yet?).

    A few of the TN Child Support Calculation changes to the calculator include: 

    • Changes to the Child Support amount based on updated poverty statistics
    • Additions to terms like Mother/Father to include gender neutral terms Parent 1/Parent 2 
    • A line added for “Adjusted for Minimum Order” on the last page of the worksheet

    According to the http://www.TN.gov website, Tennessee has a brand-new version of their Web Style Calculator coming soon. Miles Mason, a Memphis Attorney, has already updated his free child support calculator App to reflect the changes. You may want to contact an Attorney or call our office to see if these changes result an adjustment to your current Child Support amount. Finally, the Court may reject calculations done with the old version. If your divorce has not yet become final, it may be advisable to run the new worksheet.

    January 1, 2020 offers many new laws for Tennesseeans

    In our latest YouTube video there are SIX new laws for 2020 that every Tennessee citizen should know. First, we discuss the new Process Service Law. Second, we talk about consumer protection for customers using travel promoters. Next, we reveal the new law about employer-employee relationships. Then we talk about a new provision for healthcare billing clarity. The fifth topic is an overview of the Elderly and Vulnerable Adult Protection Act of 2019. Lastly, we review changes to handgun permits in Tennessee.

    Additionally, there are several other new laws that go into effect in January of 2020. Some include changes to school transportation, contractors and state employees. Next, there are changes to codes for electrical inspectors and a big consumer law change under the Right to Shop Act. Finally, there are changes to Pensions and Retirement Benefits, new rules for horse drawn vehicles, and a brand new program that effects volunteer fire departments.

    Know Your Rights

    Do not be left in the dark. Know about your legal right to obtain information from the other side in a lawsuit. First, it is impossible to settle your case without all the knowledge, documents and information. Next, Tennessee has put several rules in place that allow you to obtain that information. There are even deadlines! Additionally, you may have to subpoena some records and documents.  Subpoenas help your attorney gain a full understanding of your case. Then, you can make an informed settlement decision or offer of settlement. Finally, this should be done before you waste money attending mediation without all the facts.

    What are the grounds for divorce in Tennessee?

    Are you thinking about filing for divorce in Tennessee? There are fifteen different grounds for divorce in Tennessee! First, you need to consult with a good attorney to determine the best and most cost effective way to file. If your spouse has already filed for divorce, you can still file a counter-complaint.Then, the counter-complaint can include the grounds for divorce that you want to file. 

    Settling Quickly

    Many couples prefer to settle their divorce quickly. Therefore, Tennessee law allows one spouse to file an uncontested divorce. This uncontested ground is called Irreconcilable Differences.
